The Superior Court of Justice of Galicia has annulled the resolution of the Xunta de Galicia by which an applicant was excluded from a selective process who did not present, when applying for registration, part of the required documentation. The Administration considered, without any justification, and once the admission process had begun, that the omission of the necessary documentation in the first instance was an insurmountable error. To become an applicant, along with the application completed with personal data, it was necessary to send a certified photocopy of the qualification required for admission or, where Fax Lists appropriate, documentation proving that one was in a position to obtain it. According to the ruling, the plaintiff began the process of submitting the application for participation, but there is no evidence that he completed it and presented the copy of the application and the documentation required by the bases. On May 25, 2020, the list of those excluded was made public, among whom was the plaintiff, for not presenting the required documentation and giving those excluded a period of ten business days to correct errors. At that time, the Xunta published a note in which it reported that the reason for which the plaintiff had been excluded could not be rectified . On June 23, within the period of ten business days - since the resolution was published on June 10 in the Official Gazette of Galicia - the actor presented the required documentation. He was excluded again, arguing that the error could not be corrected and that he had submitted the documentation after the deadline.
